The hearing officer examines whether the arresting officer had reasonable cause, whether the arrest was lawful, and whether the driver had a blood alcohol content of 0.08% or higher. If the DMV fails to prove any one of these elements, the suspension can be set aside entirely. Common grounds for a favorable outcome include errors on the DS-367 form, improperly calibrated breathalyzer equipment, breaks in the chain of custody for blood samples, and officers who fail to appear when subpoenaed.
