North Tonawanda, NY – A new research report published by Luke Brown Law reveals that Niagara County residents face an elevated and growing risk of serious injury from commercial truck crashes — backed by data from four major federal and state government sources, including the Bureau of Transportation Statistics, FMCSA, NHTSA, and the NY DMV/ITSMR Traffic Safety Statistical Repository.
The report, titled “The Danger Zone You Drive Through Every Day,” focuses on a critical but often overlooked reality: Buffalo-Niagara is the #1 commercial truck crossing port in New York State, processing approximately 890,000 inbound trucks per year — roughly one every 35 seconds. Unlike passenger vehicle crossings, which dropped nearly 40% in early 2025 amid US-Canada trade tensions, commercial truck volume has not only recovered from pandemic lows but now exceeds pre-pandemic levels by 6.1%.
The result is a road environment where trucks represent a larger share of total traffic than at any point on record — and the crash data reflects that risk.
Among the report’s 11 key findings:
-
5 out of 6 people killed in large truck crashes are ordinary drivers, not truckers
-
Large truck crashes are 4.4× more likely to be fatal than the average vehicle crash
-
83% of large truck crashes in New York are caused by preventable human error
-
New York ranks in the top 10 states nationally for injury-producing large truck crashes
-
Unrepresented truck accident victims settle for an average of $103,654 — while represented victims with serious injuries recover $4.4M or more, a 42-to-1 gap
“Every commuter on I-190 or Route 62 is sharing the road with significantly more commercial freight traffic than they were just a few years ago,” said Luke Brown, personal injury attorney at Luke Brown Law. “This data makes clear that when a crash happens, the consequences for ordinary drivers are severe — and so is the cost of not understanding your legal rights.”
