StudentEB5 Publishes Guide on How Indian and Chinese Visa Holders Can Bypass Decades-Long Green Card Backlogs Through EB-5 Investment Program
StudentEB5 has published a guide on how Indian and Chinese nationals on H-1B, F-1, and J-1 visas can use the EB-5 Immigrant Investor Program to bypass decades-long green card backlogs. The EB-5 Reform and Integrity Act of 2022 enables concurrent filing, granting work and travel authorization within months. Key deadlines: September 30, 2026 grandfathering cutoff and a January 1, 2027 price increase.

StudentEB5 today published a comprehensive research article examining how Indian and Chinese nationals on J-1, F-1, and H-1B visas can leverage the EB-5 Immigrant Investor Program to circumvent employment-based green card backlogs that can span multiple decades.

The report, titled How Indian and Chinese Nationals on J-1, F-1 and H-1B Visas are Using the EB-5 Visa Program, outlines how the EB-5 Reform and Integrity Act of 2022 (RIA) fundamentally changed the landscape for nonimmigrant visa holders by introducing concurrent filing. This allows investors to file their immigrant petition and adjustment of status application simultaneously, unlocking near-term work and travel authorization within months.

The problem: decades-long backlogs and visa fragility

For Indian nationals, EB-2 and EB-3 backlogs are projected to stretch several decades under current per-country caps. H-1B workers facing a layoff have just 60 days to find a new employer, change status, or leave the country. F-1 students must win the H-1B lottery, which saw a sub-20% selection rate among more than 470,000 registrations in 2025, to remain in the U.S. long-term. J-1 physicians face a two-year home-country residency requirement that complicates any path to practice medicine in the United States.

The solution: EB-5 concurrent filing

The EB-5 program allows qualified investors, typically requiring an $800,000 investment in a Targeted Employment Area, to self-sponsor their green card without employer dependence. Under the RIA’s concurrent filing provisions, investors who file Form I-526E alongside Form I-485 can simultaneously apply for an Employment Authorization Document (Form I-765) and Advance Parole (Form I-131). These interim benefits are typically approved within four to eight months, granting the applicant and their spouse unrestricted work authorization and international travel rights while the underlying EB-5 petition is adjudicated.

Time-sensitive deadlines

The report emphasizes two approaching milestones: a grandfathering deadline on September 30, 2026, and a projected minimum investment price increase on January 1, 2027. Given that compiling source-of-funds documentation and conducting project due diligence typically requires several months of preparation, StudentEB5 advises eligible visa holders to begin evaluating their options immediately.
