CHICAGO, IL – Parents concerned about their children’s safety during parenting time with the other parent may seek supervised visitation through Illinois family courts, but obtaining such restrictions requires meeting strict legal standards. According to Chicago family law attorney Russell D. Knight, Illinois law presumes both parents are fit and courts shall not place restrictions on parenting time without proper justification. Under 750 ILCS 5/602.7(b), it is presumed both parents are fit, and courts shall not restrict parenting time unless specific findings are made. “The default is that both parents are good people who will work out parenting arrangements with little help from courts,” explains Knight.

Chicago family law attorney Russell D. Knight emphasizes that courts may order supervised parenting time only after a hearing where the court finds by a preponderance of the evidence that a parent engaged in conduct that seriously endangered the child’s mental, moral, or physical health or significantly impaired the child’s emotional development. Under 750 ILCS 5/603.10(a), courts must make specific findings before imposing restrictions.

Attorney Knight notes that supervised visitation becomes the most likely immediate result after a hearing finding serious endangerment. Courts may order supervision as one of several protective measures, including requiring exchanges through an intermediary, requiring a parent to abstain from alcohol or controlled substances during parenting time, or requiring completion of treatment programs. “The supervisor is usually a friend or family member whom both parties approve of,” he observes. “If the parties cannot approve someone jointly, they must hire someone approved by the courts.”

The firm handles custody disputes throughout Chicago and Cook County involving supervised visitation issues. Illinois courts can also restrict the presence of specific persons while a parent exercises parenting time, require a parent to post a bond to secure the return of the child, or impose any other constraints the court deems necessary to provide for the child’s safety or welfare.

Knight advises that appointing a guardian ad litem is usually necessary when parenting time restrictions are at issue. “The guardian ad litem investigates the facts, interviews the child and the parties, and can testify to the judge about what they’ve learned,” he points out. “The judge will almost always adopt the guardian ad litem’s opinion.”

Restrictions on parenting time are never permanent under Illinois law. Courts may modify an order restricting parental responsibilities if, after a hearing, the court finds by a preponderance of the evidence that a modification is in the child’s best interests based on a change of circumstances. “If your visitation was restricted or supervised, you should have asked the court to outline exactly what you need to do to have those restrictions removed,” Knight adds.
