The People’s Court has been airing on national TV for over 30 years and is where small claims disputes are arbitrated in a simulated courtroom setting.
As the opening show monologue states “What you are about to witness is real. The participants are not actors. They are actual litigants with a case pending in civil court. Both parties have agreed to drop their claims and have their cases settled here, before Judge Marilyn Milian, in our forum: The People’s Court.”
Many of the cases on the show involve the purchase of used cars. A common theme is the plaintiff is suing the seller because the car broke down shortly after the purchase and wants reimbursement from the defendant for the cost of the car and any additional expenses after the sale. In many cases these additional charges includes tow truck fees.
Regular viewers of the show will learn that the purchase of a used car is normally an “as is” sale. Unless the seller provides a third party warranty or makes express verbal warranties the buyer is accepting the car in its current condition, “as is”.
In these scenarios the defendant wins the case because the seller is not responsible for the vehicle once it leaves the lot.
“Old cars will break down, it is just a matter of time.
