Miami-Dade County commissioners adopted new micromobility regulations July 21 addressing electric bicycles, motorized scooters and other devices on public rights-of-way. The ordinance creates a framework for regulating their operation and provides mechanisms allowing municipalities to enforce restrictions on certain county-maintained roads and sidewalks.<\/p>\n

The changes come as South Florida communities confront safety concerns surrounding increasingly powerful electric transportation devices. Some e-bikes can reach speeds comparable to urban vehicle traffic, placing riders at substantial risk when collisions occur.<\/p>\n

In early September, a woman riding a scooter in Miami Beach was struck by a Jeep and became trapped beneath the vehicle near 71st Street and Bay Drive East. Police officers worked together to lift the vehicle and free her. The rider survived but suffered a fractured shoulder, and police cited the Jeep’s driver for causing the crash.<\/p>\n

The incident followed months of heightened attention to micromobility safety throughout South Florida.<\/p>\n

On the Rickenbacker Causeway, Miami-Dade officials approved regulations limiting e-bikes and scooters to a maximum speed of 20 mph and prohibiting their operation on sidewalks, requiring riders to use designated bicycle lanes or the roadway. The causeway has previously experienced serious and fatal incidents involving electric devices.<\/p>\n

Other South Florida communities have adopted their own rules. Sunny Isles Beach implemented restrictions in August requiring e-bike riders to be at least 16 years old and prohibiting e-bike operation on sidewalks.<\/p>\n

The evolving patchwork of regulations means riders may encounter different requirements depending on where they are traveling.<\/p>\n

Florida law provides the broader framework. Operators of motorized scooters and micromobility devices generally have the rights and responsibilities applicable to bicycle riders, while state law permits local governments to enact additional rules governing their use. Florida law also permits local governments to establish minimum-age and identification requirements for operators.<\/p>\n

“Someone can travel only a few miles in South Florida and potentially encounter a different set of local rules,” Serralta said. “Riders should know where they’re permitted to operate, while motorists need to recognize that they’re increasingly sharing the road with people using these devices.”<\/p>\n

Beyond regulatory compliance, visibility remains a significant safety concern. E-bike and scooter riders have considerably less physical protection than occupants of passenger vehicles. Intersections, driveways, parking lots and areas where bicycle lanes cross vehicle traffic can become particularly dangerous when motorists fail to see an approaching rider.<\/p>\n

Distracted driving can further increase the danger. A brief glance at a phone, navigation system or other distraction may prevent a motorist from noticing a scooter or e-bike until there is insufficient time to avoid a collision.<\/p>\n

Riders can also reduce risks by following applicable traffic laws, remaining visible, avoiding distractions and anticipating that motorists may not see them.<\/p>\n

When a collision occurs, determining responsibility can become complicated. Investigators and attorneys may need to consider driver behavior, rider conduct, right-of-way, traffic signals, surveillance footage, witness accounts and the specific municipal regulations governing the location where the accident occurred.<\/p>\n
