According to Brooklyn car accident attorney Samantha Kucher, the NYPD precinct of occurrence is usually the first place to request a report after a recent crash, and it can also be requested online through the NYPD Collision Report Retrieval Portal once available. “A police report can support an insurance claim, but it does not decide fault by itself,” explains Kucher. “It is one part of a larger record.”<\/p>\n

Brooklyn car accident attorney Samantha Kucher notes that drivers must separately file a Report of Motor Vehicle Crash, known as the MV-104, with the DMV within 10 days when a crash causes injury, death, or more than $1,000 in property damage. Attorney Michael Roitman adds that reports become available through the DMV at different times depending on how they were filed, ranging from about 14 days for electronically filed NYPD reports to as long as 60 days for a driver-submitted crash report. “Timing affects where you should look first,” he notes. “Recent city reports usually start with the NYPD, while older ones move through the DMV.”<\/p>\n

Kucher points out that a New York police crash report typically documents the crash location, involved vehicles and drivers, injuries, road and weather conditions, and any apparent traffic law violations, but it should not be treated as the only evidence in a claim. Photos, medical records, repair estimates, and witness follow-up can all matter, particularly when the report conflicts with other accounts of how the crash occurred.<\/p>\n

Roitman adds that drivers requesting a report at the precinct should bring a valid photo ID and as much identifying information as possible, including the crash date, precinct of occurrence, and any known plate numbers, since requests must go to the precinct where the crash happened rather than the one nearest home. He notes that DMV portal searches similarly require at least one identifier, such as a case number, plate number, or driver’s license number.<\/p>\n
