New Castle workers’ compensation attorneys Lawrence M. Kelly and Joseph A. George of Luxenberg Garbett Kelly & George P.C. (https://www.lgkg.com/pennsylvania-workers-compensation-lawyer/) explain the benefits available under Pennsylvania law and the steps injured workers must take to protect their rights.

According to New Castle workers’ compensation attorneys Lawrence M. Kelly and Joseph A. George, Pennsylvania operates under a no-fault workers’ compensation system that provides medical benefits and wage replacement regardless of who caused the workplace accident. Under Pennsylvania’s Workers’ Compensation Act (77 P.S. § 1 et seq.), virtually all employers must carry workers’ compensation coverage. The system provides guaranteed benefits through an exclusive remedy rule, meaning injured workers receive benefits without proving employer negligence, but cannot sue their employer for workplace injuries.

New Castle workers’ compensation attorneys Lawrence M. Kelly and Joseph A. George emphasize that timing is critical when reporting workplace injuries. Pennsylvania law requires workers to notify their employer within 120 days of an injury. If notice is provided within 21 days, wage-loss benefits can be owed back to the date of injury. If notice comes after 21 days but within 120 days, wage-loss benefits are generally owed only from the date notice was given. Waiting more than 120 days to report an injury can result in complete denial of benefits unless the worker can prove the employer had actual knowledge of the injury or was not prejudiced by the delay.

Pennsylvania workers’ compensation provides several categories of benefits depending on the severity and impact of the injury. Medical benefits cover reasonable and necessary treatment related to the work injury, including doctor visits, hospital care, surgery, physical therapy, prescriptions, and medical equipment. Wage-loss benefits replace approximately two-thirds of the worker’s average weekly wage, subject to a maximum that changes annually based on the injury date. For injuries occurring in 2026, the maximum weekly compensation rate is $1,394.

“Wage-loss and medical benefits can continue as long as they remain legally payable, but they can also be modified, suspended, or stopped through the claims process,” Kelly explains. “Benefits depend on work status, earnings, agreements, or a judge’s decision.”

Workers who can return to employment but earn less due to physical restrictions may qualify for partial disability wage-loss benefits. Pennsylvania law generally caps partial disability status at 500 weeks. The system also provides specific loss benefits for scheduled injuries involving loss of specific body parts, such as hands, feet, or eyes, with benefits based on a set number of weeks for each body part. Death benefits include reasonable funeral and burial expenses up to $7,000 plus weekly benefits to eligible dependents.

Kelly and George note that Pennsylvania workers’ compensation covers a broad range of injuries and occupational diseases. Covered injuries include back and neck injuries such as herniated discs and spinal injuries from lifting or falls, fractures and broken bones from falls or struck-by accidents, lacerations and amputations from machinery or equipment, burns from thermal or chemical exposures, head injuries and concussions, repetitive stress injuries like carpal tunnel syndrome, occupational diseases including hearing loss and respiratory conditions, and some work-related psychological injuries. Pre-existing conditions do not disqualify workers from benefits if workplace activities aggravate or worsen the condition.

“Pennsylvania law recognizes that work can accelerate, exacerbate, or contribute to a pre-existing injury,” George notes. “Workers can receive benefits for the worsening of their condition even if they had problems before the injury.”

The claims process requires specific steps to protect benefits. Injured workers must notify their employer immediately after an injury and seek medical treatment. If the employer has a properly posted panel list of at least six approved physicians, workers may be required to treat with a listed provider for the first 90 days. After 90 days or if no proper panel was posted, workers can generally be treated with a provider of their choice. Employers should provide forms to document the injury, and workers must complete these forms thoroughly while keeping copies for their records.

Insurance companies deny many legitimate workers’ compensation claims based on disputes about whether the injury occurred at work, whether it was reported on time, or the severity of the injury. Pennsylvania law provides a litigation process through the Workers’ Compensation Office of Adjudication. When claims are denied or benefits stop, workers can pursue their case by filing a Claim Petition, generally within three years of the injury date.

Hearings before a Workers’ Compensation Judge allow injured workers to present evidence, including medical records, physician testimony, and testimony about how the injury occurred. Insurance companies typically present their own medical evidence. After the record closes, the Workers’ Compensation Judge issues a written decision. Appeals to the Workers’ Compensation Appeal Board must be filed within 20 days of the judge’s decision being circulated, with further appeals potentially proceeding to the Commonwealth Court and Pennsylvania Supreme Court.

Kelly and George warn that insurance companies employ several tactics to minimize legitimate claims. Carriers may start paying benefits without admitting claim validity through a Notice of Temporary Compensation Payable, which allows them to stop payments at any time without a hearing. After 90 days, insurers must either accept the claim with a Notice of Compensation Payable or deny it with a Notice of Denial. Many carriers wait until day 89 before filing a denial, forcing workers into the appeals process.

“Insurance companies often approach injured workers with settlement offers soon after an injury,” Kelly advises. “These lump-sum settlements typically offer far less than the total value of the claim, and once accepted, workers give up all rights to future benefits for that injury.”

Insurance companies can require injured workers to attend Independent Medical Examinations. Despite the name, these examinations are not truly independent because the insurance company hires and pays the examining physician. These doctors often minimize injuries or claim workers have reached maximum medical improvement earlier than treating physicians believe. Workers must attend properly noticed examinations or risk benefit suspension, but they are not required to provide lengthy medical histories or answer unrelated questions.

Pennsylvania law protects employees from termination in retaliation for seeking workers’ compensation benefits. If an employer fires a worker because they filed or pursued a workers’ compensation claim, the worker may have a separate wrongful termination claim under Pennsylvania case law. These retaliation cases are fact-specific and require careful documentation of job performance, timing of discipline, and communications regarding the workers’ compensation claim.

For occupational diseases that develop gradually such as hearing loss or carpal tunnel syndrome, the 120-day notice period begins when the worker knows or should have known that the condition is work-related. This timeline can be challenging to establish, and workers who develop conditions over time should consult legal counsel to ensure compliance with notice requirements.

Lawrence M.
