William H. Harding scored a victory for the people when he recently settled an $825,000 lawsuit against the Charlotte-Mecklenburg Police Department for their negligence during the arrest of a 18-year old Charlotte woman.

Harding scored a victory for the people when he recently settled an $825,000 lawsuit against the Charlotte-Mecklenburg Police Department. The incident involved an 18-year old Charlotte woman and three Charlotte-Mecklenburg Police officers.

The lawsuit stemmed from events that took place when Tanisha Williams, who had a documented history of mental illness, was refused proper medical care. Williams was apprehended and put in the back of a police car, where she repeatedly banged her head on the plexiglass and strangled herself with a seat belt for more than six minutes.

The result of those actions left Williams with severe brain damage. It also left Williams unable to care for herself. Because of those injuries, Williams cannot talk, walk or even feed herself. There was also video surveillance of this disturbing incident.

The incident occurred in December of 2011 when Williams was arrested for allegedly shoplifting. It turned out to be Williams’ grandmother who filed the lawsuit. She is also Williams’ caretaker and referenced the Americans with disabilities Act in her pursuit of the lawsuit.

The rights of the disabled are not to be violated under any circumstance and that was more than enough cause for Harding to take on this case. One of the three arresting officers also had a previous charge for assault on his record. That made this personal injury lawsuit even more important as it was about more than just money. The need to halt police negligence is a task that is ongoing and crucial to the city of Charlotte.

“I filed the lawsuit not just for money, but to change the way the police handle those who they take into custody,” Harding said. “Tanisha is alive, but she has no enjoyment of life. All those officers had to do was take her out of that backseat.”

An internal investigation was conducted, but it did not find any of the three officers at fault. Only one of the three officers is still working for the CMPD. However, that did not stop the pursuit of justice as Harding headed up a lawsuit against the CMPD.

Harding has made it a point to fight for the rights of those who have been violated and is not at all hesitant about taking on entire police departments.
